– उत्तराखंड विधानसभा में नियुक्तियों में फर्जीवाड़े से जुड़ा है जांच का मामला

जनपक्ष टुडे ब्यूरो, देहरादून। विधानसभा में विवादित नियुक्तियों की जांच को लेकर गठित समिति अब खुद विवादों में घिर गई है। दरअसल, जांच समिति को लीड कर रहे रिटायर्ड आईएएस डीके कोटिया को लेकर ही अब कई तरह के सवाल खड़े किए जा रहे हैं। भाकपा माले से लेकर मुख्य विपक्षी दल कांग्रेस इस मामले में हमलावर हैं।

बता दें कि विधानसभा नियुक्तियों में विवाद सामने आने के बाद मुख्यमंत्री पुष्कर सिंह धामी के अनुरोध पर विधानसभा अध्यक्ष ऋतु खंडूरी ने जांच के आदेश देते हुए पूरे प्रकरण की जांच को लेकर रिटायर्ड आईएएस डीके कोटिया की अगवाई में जांच समिति बनाई हुई है। इस समिति को आगामी 3 अक्टूबर तक अपनी रिपोर्ट देनी थी, लेकिन सूत्र बताते हैं कि समिति अगले एक दो दिन में ही अपनी रिपोर्ट सौंपने की तैयारी में है।

इस बीच, अब जांच समिति के अध्यक्ष को लेकर ही सवाल खड़े किए जा रहे हैं। इतना ही नहीं विधानसभा अध्यक्ष जो कि अपने आप मे विधानसभा में संवैधानिक रूप से सबसे बड़ा पद है उनकी जांच कार्यपालिका से कराए जाने पर भी जानकर हैरत जता रहे हैं। जानकारों का कहना है कि विधायिका की जांच कार्यपालिका नहीं कर सकती। ऐसे में तमाम चीजों को लेकर जांच समिति खुद विवादों के घेरे में है।

भाकपा माले ने विस में बैकडोर भर्तियों की जांच के लिए गठित समिति को लेकर सवाल उठाए। संगठन के गढ़वाल सचिव इंद्रेश मैखुरी ने कहा कि जांच समिति के अध्यक्ष रिटायर्ड आईएएस अफसर डीके कोटिया उत्तराखंड पब्लिक सर्विस ट्रिब्यूनल में उपाध्यक्ष रह चुके हैं। ऐसे में नियमानुसार उन्हें समिति में शामिल नहीं किया जा सकता है।

मैखुरी ने इस संबंध में विधानसभा अध्यक्ष ऋतु खंडूड़ी को भी एक ज्ञापन भेजा है। ज्ञापन में उन्होंने कहा कि यूपी पब्लिक सर्विस ट्रिब्यूनल ऐक्ट 1976 की धारा तीन, 11 के अनुसार, पब्लिक सर्विस ट्रिब्यूनल में अध्यक्ष, उपाध्यक्ष और सदस्य रहे व्यक्ति को उसके बाद कहीं भी तैनाती नहीं दी जा सकती। यहां तक कि इन पदों पर तैनात रहे व्यक्ति वकालत भी नहीं कर सकते।

ऐसे में इस जांच समिति में रिटायर्ड आईएएस अफसर डीके कोटिया को रखा जाना गलत है। उन्होंने कहा कि ऐसी कमेटी की रिपोर्ट का कोई वैधानिक अस्तित्व भी नहीं है।

विदित है कि विधानसभा में बैकडोर भर्तियों का मामला सुर्खियों में आने के बाद स्पीकर ने जांच को कोटिया की अध्यक्षता में तीन सदस्यीय समिति का गठन किया है। यहां तक कि कोटिया की राज्य स्वास्थय प्राधिकरण में त्रिवेंद्र कार्यकाल में चैयरमेन पद पर हुई नियुक्ति को भी नियम विरुद्ध करार दिया जा रहा है।

वहीं, कांग्रेस के प्रदेश अध्यक्ष करन माहरा ने कहा कि विधानसभा की भर्तियों की जांच, हाईकोर्ट के सिटिंग जज से ही कराना विधानसभा की गरिमा के अनुकूल होगा। विधानसभा के पूर्व अध्यक्षों के फैसलों की जांच एक रिटायर आईएएस अधिकारी से कराने से प्रदेश में गलत परंपरा जन्म ले लेगी।

माहरा ने कहा कि यहां बात किसी को ऊंचा या नीचा ठहराने की नहीं है। बात नैतिकता और संसदीय परंपराओं की रक्षा की है। उन्होंने कहा कि जिन लोगों को जनता ने पूरे विश्वास के साथ चुनकर विधानसभा भेजा। उन्हीं लोगों ने जनता की पीठ में छुरा घोंपते हुए अपने रिश्तेदारों और करीबियों को बैकडोर से नौकरियां दे दीं। राज्य के युवाओं के हक पर डाका डाला गया।

यह नैतिकता के पतन का मामला है और अब तक विधानसभा अध्यक्ष के फैसलों का मूल्यांकन सुप्रीम कोर्ट अथवा हाईकोर्ट के न्यायाधीश ही करते रहे हैं। माहरा ने कहा कि विधानसभा अध्यक्ष के पद के सम्मान के लिहाज से यह उचित भी है। लेकिन आईएएस से जांच कराना किसी भी दृष्टि से उचित नहीं है।
